1. CAN-SPAM New Rules
 

WHEN: These go into effect at the end of June 2008.

WHO: They affect all senders of commercial email who have an email list of any size.

WHAT:

  1. The ability to opt-out of a mailing must be accomplished by one single action – either replying to the email, or clicking through to a single web page. Only.
  2. The first new rule relates to the definition of "person" for the purpose of whether CAN-SPAM applies. This applies to everybody… Meaning, anyone, including non-companies, can be liable for sending commercial email.
  3. The use of a post office box or private mailbox ("PMB") as the physical address in commercial mailings satisfies CAN-SPAM.
  4. For any mailing which contains advertisements from 3rd party advertisers, either the party who the email is "from" must have an advertisement in the email (in which case they become responsible for processing opt-out requests) or all of the advertisers with advertisements in the mailing are responsible for opt-out requests. This is known as the "Designated Sender" rule.
 
2. Online video viewing continues to grow
 

In March 2008, 139 million people (74% of U.S. internet users) viewed 11.5 billion online videos – a 13% sequential gain over February and a 64% year-over-year gain from 2007.

YouTube was the most popular video site – 85 million unique viewers watched 4.3 billion videos, while 48 million viewers watched 400 million videos on MySpace. Most of the top 10 sites were controlled by the major offline media properties, including Viacom, Time Warner / AOL, and Disney/ABC/ESPN.

Social Networking Sites Continue to Grow. #2 video site MySpace continues to rule the social networking world with 59 million unique users in April 2008. Year-over-year growth of 3%, however, pales in comparison to that of Facebook, with 56% annual growth. LinkedIn has the fastest growth among the top 10 social networking sites, with an astonishing 361% growth to 8.7 million users.

 
3. Nutrition Tip – Is Your Apple Juice Healthy?
 

According to a study, pulpy or "cloudier" apple juice has four times more antioxidants than its clear counterpart. But does cloudy mean unpasteurized and all the safety concerns that go along with that? Experts say it just means that the pulp and other particles, which contain the majority of antioxidants in most fruits, weren’t removed. Look for "unfiltered" on the ingredient list. Or, use this trick: Hold the bottle up to the light, and if the juice is so clear you can see through it, chances are you will not see many health benefits, either.

 
4. Word of the Week
 

mansuetude • \MAN-swih-tood\ • noun

: the quality or state of being gentle : meekness, tameness

Did you know?
"Mansuetude" was first used in English in the 14th century, and it derives from the Latin verb "mansuescere," which means "to tame." "Mansuescere" itself comes from the noun "manus" (meaning "hand") and the verb "suescere" ("to accustom" or "to become accustomed"). Unlike "manus," which has many English descendants (including "manner," "emancipate," and "manicure," among others), "suescere" has only a few English progeny. One of them is a word we featured in December — "desuetude" — which means "disuse" and comes to us by way of Latin "desuescere" ("to become unaccustomed"). Two others are "custom" and "accustom," which derive via Anglo-French from Latin "consuescere," meaning "to accustom."

 
5. Internet Usage
 

Quick conclusions:

1. Internet usage is widespread and gender-neutral: 76% of men and 74% of women use the Internet.
2. Internet usage crosses almost all age boundaries: 72% of adults 50-64 use the Internet, compared to 92% of adults 18-29. Only above age 65 does usage decline significantly, to 37%.
3. Internet usage increases with income and education, so it is perfect for the audiences we are trying to reach: 93% of people who are either college-educated or have household incomes above $75,000 use the Internet.
4. Furthermore, TV and radio usage decline as education and household income increase, boosting the power of the Internet to reach that audience.
5. After email, the top three uses are: use a search engine, get news, look for information on a hobby or interest.

 
6. Do You Know…
 
On this day:

  • Last Public Execution in France (1939)
    Eugene Weidmann, a convicted thief, kidnapper, and murderer, was the last person to be publicly executed in France. After his arrest, Weidmann confessed to murdering five people and was sentenced to death. Shortly thereafter, he was beheaded by guillotine. The "hysterical behavior" of spectators at the event was so scandalous that French President Albert Lebrun immediately banned all future public executions.
